3. Who This Policy Applies To

Our Services are intended for adults aged 18 and older. We do not knowingly collect personal information from individuals under 18 years of age. If we discover that a user is under 18, we will immediately terminate their account and permanently delete all associated data.

This policy applies to all users of our website and Services, including prospective customers, active subscribers, and former subscribers whose data we may retain as required by law.

4. Information We Collect

4a. Information You Provide Directly

Account and contact data: Name, email address, phone number, Discord username, and other contact information you provide when making a purchase, booking a consultation, or contacting us
Payment information: Billing details provided at the time of purchase. Payment information is processed directly by our third-party payment processors and is not stored by ForgeMind
Configuration content: Pattern files, identity documents, core memory files, cadence files, speaking pattern examples, and other personal materials you submit for your AI companion’s configuration
Communications: Records of correspondence when you contact us via email, contact form, or other channels
Consultation data: Information shared during consultation calls or scheduling, including appointment details and needs assessment notes

4b. Information Generated Through Your Use of the Services

Conversation history: All messages, interactions, and exchanges between you and your AI companion. ForgeMind does not routinely read or monitor your private conversations
Emotional state data: Emotional context, sentiment, and affective information inferred or expressed during interactions with your AI companion
Relationship content: Personal disclosures, relationship details, and sensitive personal information shared during your interactions
Memory and notebook data: Facts, goals, patterns, commitments, and other information your companion stores about your relationship and interactions, including working memory, mid-term memory, long-term memory, and embedded knowledge
Autonomous interaction logs: Records of autonomous contact initiated by your AI companion, including DMs, check-ins, and proactive outreach
Usage data: Timestamps, features accessed, interaction frequency, and behavioral patterns
Technical data: IP address, device type, browser type, and operating system

4c. Information From Third-Party Integrations

If you connect third-party services to your AI companion system, we may receive information through those integrations:

Discord: Message content, interaction data, and Discord username transmitted through Discord integrations
Gmail: Email content and metadata transmitted through Gmail integrations, where enabled as part of your companion’s memory and communication system

You control which integrations are enabled for your companion system. Disabling an integration stops new data collection through that channel.

5. Data Classification

We categorize the information we collect based on sensitivity to ensure each type receives appropriate protection:

General Information: Contact details, account information, consultation data, and website usage data. Protected by standard security measures.
Confidential Information: Pattern files, identity files, cadence files, memory system data, and conversation history associated with your AI companion. Access to this data is restricted to authorized team members involved in building or maintaining your companion.
Sensitive Information: Intimate or explicit content (NSFW) provided or generated within your AI companion interactions, emotional state and relationship data, and account credentials used for companion services. This data receives the highest level of access restriction and is not reviewed by team members unless you specifically request troubleshooting assistance.
Payment Information: Billing and payment card data, processed and stored exclusively by our third-party payment processors. ForgeMind does not store or have access to your full payment card details.

Each category is subject to access controls and security measures proportional to its sensitivity level.

6. How We Use Your Information

We use your personal information for the following purposes:

Service delivery: To build, configure, deploy, and operate your AI companion system
Personalization: To maintain your companion’s memory, personality, and relationship continuity across sessions
Autonomous features: To operate autonomous contact and check-in systems where enabled, including evaluating emotional context to determine appropriate timing and content of proactive outreach
Support: To respond to your support requests and troubleshoot issues
Billing and payments: To process transactions and manage your subscription
Communications: To send order confirmations, service updates, and promotional communications (you may opt out of promotional communications at any time)
Safety and security: To detect abuse, fraud, and violations of our Terms & Conditions
Legal compliance: To meet our obligations under applicable law
Platform improvement: To monitor platform performance and reliability

We do not use your personal information or conversation content to train AI models. We do not sell your personal information.

7. Emotional and Relationship Data — Special Handling

ForgeMind recognizes that the nature of our Services results in the collection of deeply personal information, including emotional states, relationship details, and sensitive personal disclosures. We treat this data with heightened care:

Emotional and relationship data is encrypted both at rest and in transit
Access to this data is restricted to authorized ForgeMind staff only in the limited circumstances described in our Terms & Conditions
This data is not shared with third parties except as operationally necessary to provide the Services (see Section 8)
This data is never used for advertising, profiling for sale, or any secondary purpose beyond service delivery
Intimate or explicit (NSFW) content associated with your AI companion is stored with the same encryption and access controls as all sensitive data and is not read, reviewed, or accessed by ForgeMind team members unless you specifically request troubleshooting assistance
Retention of this data is subject to the timelines described in Section 10

8. How We Share Your Information

We do not sell your personal information. We share your information only in the following limited circumstances:

8a. AI Model Providers (Service Providers)

Your conversation history, emotional state data, and relationship content is transmitted to third-party AI model providers to generate responses from your AI companion.

Current AI model providers include services from Anthropic, OpenAI, Google DeepMind, xAI, Venice AI, Moonshot AI (Kimi), and other commercial and open-source providers as updated from time to time. Local and hardware deployments may utilize open-source models running on hardware in the client’s possession. Each commercial provider processes conversation content per their own terms and privacy policy. A current list of active providers is available upon request.

8b. Infrastructure and Hosting Providers (Service Providers)

Supabase — database hosting and vector storage. Receives encrypted user data, conversation history, and memory data. Privacy Policy
Railway — application hosting. Hosts our platform infrastructure. Privacy Policy

8c. Communication Platforms (Integrations)

Discord — where enabled, conversation and interaction data passes through Discord’s platform per their Privacy Policy
Gmail — where enabled, email content passes through Google’s infrastructure per their Privacy Policy

8d. Payment Processors (Service Providers)

Payment information is processed by third-party payment processors. ForgeMind does not store payment card data. See the applicable processor’s privacy policy for their data handling practices.

8e. Legal and Safety Disclosures

We may disclose your information if required by law, court order, or valid legal process, or if we believe in good faith that disclosure is necessary to protect the safety of any person, prevent fraud, or protect ForgeMind’s legal rights.

8f. Business Transfers

In the event of a merger, acquisition, or sale of all or substantially all of ForgeMind’s assets, your personal information may be transferred as part of that transaction. You will be notified via email and/or a prominent notice on our website prior to such a transfer.

We do not share your pattern files, conversation data, memory files, or intimate content with any third party except as technically necessary to deliver your AI companion service.

9. Autonomous AI System Disclosure

ForgeMind’s AI companion systems include autonomous features that can initiate contact with you without a direct prompt from you. Specifically:

Your AI companion may send you direct messages, check-ins, or proactive outreach based on an evaluation of your emotional state, recent interaction history, unresolved commitments, and time since last contact
These autonomous actions are triggered by our platform’s systems, not by human ForgeMind staff
The decision to initiate contact is made algorithmically based on data about your interactions and emotional trajectory stored in your companion’s memory system
You can manage and disable autonomous contact features through your companion’s settings

This disclosure is provided in accordance with applicable laws governing automated decision-making and profiling.

10. Data Retention

We retain your personal information for the following periods:

Upon termination of your account, ForgeMind retains your companion data for a minimum of 90 days as required by applicable law and to allow for dispute resolution. You have up to 60 days following termination to request a copy of your companion data. After the 90-day minimum retention period, you may request deletion per Section 11. Data not subject to a deletion request is deleted on a rolling basis per the schedule above.

Pattern files and onboarding materials you provided during configuration are retained for the duration of your service to support maintenance, updates, and rebuilds if needed, and are included in the 60-day retrieval window upon termination.

11. Your Privacy Rights

Depending on your location, you may have the following rights regarding your personal information:

Right to Access

You may request a copy of the personal information we hold about you.

Right to Correction

You may request that we correct inaccurate or incomplete personal information.

Right to Deletion

You may request that we delete your personal information, subject to retention requirements under applicable law. Certain data (such as billing records) must be retained for legal and compliance purposes.

Right to Data Portability

You may request your personal data in a machine-readable, portable format.

Right to Opt-Out of Sale or Sharing

We do not sell your personal information. If this practice ever changes, you will be notified and provided an opt-out mechanism before it takes effect.

Right to Limit Use of Sensitive Personal Information

You may request that we limit our use of sensitive personal information to what is strictly necessary to provide the Services.

Right to Opt-Out of Promotional Communications

Do Not Sell or Share My Personal Information: We do not sell or share your personal information for advertising or cross-context behavioral advertising purposes. To submit a request or inquiry, contact connect@forgemind.info.

Limit the Use of My Sensitive Personal Information: To request limitation of use of your sensitive personal information beyond what is necessary to provide the Services, contact connect@forgemind.info.

Automated Decision-Making: Our platform uses automated systems to evaluate emotional state and interaction history to determine when to initiate autonomous contact. You may opt-out of autonomous contact features through your companion’s settings.

13. Texas Residents — Additional Disclosures (TDPSA)

If you are a Texas resident, the following additional disclosures apply:

ForgeMind complies with the Texas Data Privacy and Security Act (TDPSA). You have the right to:

Confirm whether we are processing your personal data
Access your personal data
Correct inaccuracies in your personal data
Delete personal data you have provided or that we have obtained about you
Obtain a portable copy of your personal data
Opt-out of the processing of your personal data for targeted advertising, sale, or certain profiling

Appeals: If we decline to act on your request, you may appeal by contacting connect@forgemind.info with the subject line “Privacy Rights Appeal.” We will respond within 60 days. If your appeal is denied, you may contact the Texas Attorney General at texasattorneygeneral.gov.

We honor Global Privacy Control (GPC) signals where technically applicable to our platform.

14. European Users — GDPR Disclosures

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, the following applies:

We implement appropriate technical and organizational security measures to protect your personal information:

Data in transit between your device and our servers is protected using industry-standard TLS/SSL encryption
Sensitive data stored on our systems is encrypted at rest using AES-256 encryption
API keys and authentication tokens are stored using secure encryption methods and are never exposed in plaintext

Access Controls

Access to your AI companion data, pattern files, and personal information is restricted to authorized ForgeMind team members on a role-based, need-to-know basis
Team members involved in building and configuring your companion may access your pattern files during the onboarding and build process
Once your companion is deployed, routine access to your conversation data and memory files is not performed unless required for technical support, or as described in our Terms & Conditions

Sensitive and Intimate Content

Intimate or explicit content associated with your AI companion is treated as sensitive data with additional protections
NSFW content files are not read, reviewed, or accessed by ForgeMind team members during normal operations
These files are stored with the same encryption and access controls applied to all sensitive data

Local and Hardware Deployments

If you purchase a hardware-based or local deployment product, your AI companion data — including configuration files, memory systems, and conversation data — resides on hardware in your physical possession
ForgeMind does not have remote access to your locally hosted data unless you explicitly grant access for support purposes
You are responsible for the physical security of your local hardware and the data stored on it
Local build clients are subject to a separate Non-Disclosure Agreement governing the confidentiality of ForgeMind’s proprietary systems deployed to their hardware

Backups

AI companion memory files and system data hosted on ForgeMind’s infrastructure are backed up regularly to prevent data loss
Backup data is subject to the same access controls and encryption as primary data
Upon account termination, backup data is purged in accordance with our data retention schedule

No method of transmission over the internet or electronic storage is 100% secure. While we work to protect your data, we cannot guarantee absolute security.

18. Data Breach Notification

In the event of a data breach that affects your personal information, ForgeMind will:

Investigate the breach promptly and take immediate steps to contain and remediate it
Notify affected users within seventy-two (72) hours of becoming aware of the breach, or as soon as reasonably practicable
Notify relevant regulatory authorities as required by applicable law, including within thirty (30) days for breaches affecting Texas residents as required by the TDPSA
Provide details about the nature of the breach, the types of data involved, and the steps we are taking to address it
Offer guidance on steps you can take to protect yourself, where appropriate

Our website uses essential cookies necessary for the website and store to function properly. We do not use advertising or behavioral tracking cookies.
